These Terms of Service (“Terms”) govern access to and use of the website located at aschdd.com, as well as any purchase of products from Zloff Digital LLC, doing business as American Sonde Company (“ASC,” “we,” “our,” or “us”). By accessing the website or purchasing any product from ASC, you acknowledge that you have read, understood, and agree to be bound by these Terms.
American Sonde Company operates as an independent supplier of horizontal directional drilling equipment, including DigiTrak compatible transmitters. Unless expressly stated in writing, ASC is not the manufacturer of the products offered for sale. All products are offered subject to availability, and ASC reserves the right to modify, discontinue, or limit the availability of any product at any time without notice.
While ASC makes reasonable efforts to ensure that product descriptions, specifications, and pricing are accurate, no representation or warranty is made that such information is complete, accurate, or current. Product images are provided for reference purposes only. Equipment, particularly refurbished or previously used items, may exhibit variations in appearance or performance. ASC does not guarantee compatibility with any specific equipment, system, or jobsite conditions unless such compatibility is expressly confirmed in writing.
All orders are subject to acceptance by ASC. We reserve the right, in our sole discretion, to refuse, cancel, or limit any order for any reason, including but not limited to suspected fraud, pricing errors, or product unavailability. Payments are processed through third-party providers, including Stripe via WooPayments. ASC does not store or directly process payment card information. Prices are subject to change at any time without notice.
Shipping timeframes provided by ASC are estimates only and are not guaranteed. ASC shall not be responsible for delays arising from carriers, weather conditions, supply chain disruptions, or other events beyond its control. Title to and risk of loss for all products pass to the customer upon delivery of the product to the carrier.
Returns, refunds, and exchanges are governed exclusively by the ASC Refund and Returns Policy, which is incorporated herein by reference. No refund or return will be accepted for products that have been damaged due to misuse, improper installation, impact, overheating, water intrusion, or unauthorized modification.
Any warranty applicable to products sold by ASC is governed solely by the ASC Warranty Policy. Unless explicitly stated, ASC does not provide manufacturer warranties. Except as expressly set forth in the Warranty Policy, all products are provided on an “as is” and “as available” basis, and ASC disclaims all implied warranties, including but not limited to merchantability and fitness for a particular purpose, to the fullest extent permitted by applicable law.
Products sold by ASC are intended for use by trained and experienced horizontal directional drilling professionals. By purchasing or using any product, the customer acknowledges and assumes all risks associated with installation, operation, and use in field conditions. Such risks include, but are not limited to, equipment failure, inaccurate readings, property damage, financial loss, personal injury, and project delays. ASC shall not be liable for any damages arising from improper use, improper installation, or failure to follow applicable operational guidelines.
To the fullest extent permitted by law, ASC shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, loss of business, project delays, or contractual penalties. In all cases, ASC’s total liability arising out of or related to any claim shall be strictly limited to the amount paid by the customer for the specific product giving rise to the claim.
You agree not to initiate any chargeback or payment dispute without first contacting ASC to attempt a good faith resolution. ASC reserves the right to submit order documentation, delivery confirmation, and communication records to payment processors in response to any dispute. Fraudulent transactions, abuse of chargeback mechanisms, or bad faith disputes may result in denial of future service and potential legal action.
All trademarks, product names, and logos referenced on this website are the property of their respective owners. American Sonde Company is not affiliated with, endorsed by, or authorized by DigiTrak or any related entity. Any reference to third-party trademarks is used strictly for identification and compatibility purposes.
You agree not to misuse the website, attempt unauthorized access to any system, or interfere with the proper functioning of the website. ASC reserves the right to modify, suspend, or discontinue any aspect of the website at any time without notice.
Any dispute, claim, or controversy arising out of or relating to these Terms, the use of the website, or any purchase made from ASC shall first be subject to a good faith effort at informal resolution. If such dispute cannot be resolved, it shall be resolved through binding arbitration conducted within the Commonwealth of Pennsylvania, except where prohibited by law. To the fullest extent permitted by law, you waive any right to a jury trial or participation in a class action proceeding.
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles.
ASC reserves the right to update or modify these Terms at any time. Any changes will be effective upon posting to the website. Continued use of the website or purchase of products after such changes constitutes acceptance of the revised Terms.
